HUSA Update
Pat Shillito wrote an excellent article on HUSA – Council may sever ties with Uptown district
Since that report there have been some tentative updates.
Streets and Highways Code 36550 (b) requires
The city council shall adopt a resolution of intention to
disestablish the area prior to the public hearing required by this
section. The resolution shall state the reason for the
disestablishment, shall state the time and place of the public
hearing, and shall contain a proposal to dispose of any assets
acquired with the revenues of the assessments levied within the
parking and business improvement area. The public hearing shall be
held not less than 20 or more than 30 days after the adoption of the
resolution of intention. Notice of the public hearing shall be
published as provided in Section 36523.
Because of the limitations of this code section discussion of HUSA will probably not take place until October 15, 2008. If the council decides to move forward it would adopt an appropriate resolution and then set a public hearing for November 5, 2008.
In short, those who are reporting about the demise of HUSA are a bit premature. Additionally, any action by the council would likely only address the district and assessments. The organization that we know as HUSA would not be affected by the council decision. The nonprofit organization could continue or the board of directors could properly and legally close the organization.
Again, there is more work to be done and this is hardly a done deal.
